La rémunération de l’avocat

The lawyer’s remuneration

There are different ways in which a lawyer can be paid: it can either be done on a flat rate basis, or at an hourly rate. Additional remuneration may also be decided on the basis of a judicial result. The fees are generally fixed by the lawyer in agreement with his client, and a relative agreement shall be concluded between both parties. As such, the payment method and the hourly rate shall also be mentioned in this agreement. There are a number of factors that affect a lawyer's fees, such as his or her level of specialization, the urgency of the case, or its degree of complexity.

Lawyer’s fees

Fees invoiced on a time-spent basis

If there is an agreement between the client and the lawyer to invoice fees on a time-spent basis, the latter will invoice his services according to the duration of the case and on the basis of an hourly rate. The fees will thus take into account the duration of consultations, complications, hearings, telephone conversations made by the lawyer in connection with the case… Such mode of remuneration is suitable for complex cases where it is difficult to fix in advance the time required for intervention.

Flat-rate fees

This type of remuneration consists of fixing an all-inclusive package at the outset, which prevents the client from a budget overrun. Flat-rate remuneration is mainly used in simple cases, such as an amicable divorce or a dispute between landlord and tenant because of unpaid rents. Flat-rate fees can sometimes be accompanied by bonuses based on results.

Contingency fees

As the name suggests, this type of fee depends on the outcome of the case. The lawyer will then be paid depending on the success of the action and the trial. However, it should be noted that Contingency fees are complementary and generally associated to flat-rate fees. It is forbidden by law to condition the payment of an attorney to a positive result.
L’aide juridictionnelle

Legal aid

In order to guarantee access to the law for all, the State has set up a legal aid system, which allows those who cannot afford a lawyer to hire one. That is to say that the State will pay part or all of your lawyer's fees, if you are eligible for legal aid. Your eligibility will depend on many criteria, and mainly on your resources.

Challenging lawyers' fees

Each client has the right to request conclusion of a fee agreement with his lawyer with a view to protect himself from a possible inflation of the final tariff. In the event of failure to comply with the agreement, the client may initiate a challenge of fees by sending a registered letter (with acknowledgment of receipt) to the Chairman of the Bar Association or to the Consumer Ombudsman.
